Pathways College On Demand provides a subscription service that allows our members to access Pathways College Online videos ("Pathways College On Demand content") streamed over the Internet to certain Internet-connected TVs, computers and other devices. 

The Pathways College On Demand service is provided to you by Pathways College of Bible and Mission. These Terms of Use govern your use of our service. As used in these Terms of Use, " Pathways College On Demand service", "our service" or "the service" means the service provided by Pathways College On Demand for discovering and watching Pathways College On Demand content. 

1. Membership. 
Your Pathways College On Demand membership will continue month-to-month until terminated. To use the Pathways College On Demand service you must have Internet access and a device able to use the content. 

2. Free Trials

2.1. Your Pathways College On Demand membership may start with a free trial. The free trial period of your membership lasts for one month, or as otherwise specified during sign-up and is intended to allow new members and certain former members to try the service.

2.2. Free trial eligibility is determined by Pathways College On Demand at its sole discretion and we may limit eligibility to prevent free trial abuse. We reserve the right to revoke the free trial and put your account on hold in the event that we determine that you are not eligible. 

3. Pathways College On Demand Service
3.1. The Pathways College On Demand service and any content viewed through the service are for your local church or groups personal and non-commercial use only. During your Pathways College On Demand membership we grant you a limited, non-exclusive, non-transferable license to access the Pathways College On Demand service and view Pathways College On Demand content. You agree not to use the service for public performances outside of your local church or group.

3.2. Pathways College On Demand regularly makes changes to the service, including the content library. In addition, we continually test various aspects of our service, including our website, user interfaces, promotional features and availability of Pathways College On Demand content.

3.3. Pathways College On Demand content is available to download to your device. This content is able to be used as long as you are a subscribed member to Pathways College On Demand. If you cancel your subscription you need to delete any downloaded content from all devices. 

3.4. You agree to use the Pathways College On Demand service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the Pathways College On Demand service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the Pathways College On Demand service; use any robot, spider, scraper or other automated means to access the Pathways College On Demand service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the Pathways College On Demand service; insert any code or product or manipulate the content of the Pathways College On Demand service in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Pathways College On Demand service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.

3.5. The quality of the display of the Pathways College On Demand content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. 

4. Passwords and Account Access. 
Once an legitimate account has been made, we will approve the request and you may begin to use Pathways College On Demand. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold in order to protect you, Pathways College On Demand or our partners from identity theft or other fraudulent activity.

5. Warranties and Limitations on Liability.
The Pathways College On Demand service is provided "as is" and without warranty or condition. In particular, our service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. These terms will not limit any non-waivable warranties or consumer protection rights that you may be entitled to under the laws of your country of residence.6.1. Liability Limitation

5.1 Liability Limitation. Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. The conditions, warranties and guarantees set out in the Sale of Goods Act 1908 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.

We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information provided on our website. To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993. Our maximum liability to you (if any) shall be limited to the value of any faulty products or services supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises.

6. Privacy and Confidentiality
Unless you opt to receive messages from us we will not contact you again in future. If you have opted to receive ongoing communications and at a later date you no longer wish to receive these communications you will be able to opt out of receiving this information by contacting us by email or by following the unsubscribe instructions at the bottom of emails sent to you. Opting out of receiving the above mentioned messages will not prevent the sending of messages that specifically relate to your order(s).We may use personal information that we collect about you to provide products and services to you. You will need to permit us to place data files ("cookies") on your computer to enable you to use some features of some of our websites. Where you choose not to enable cookies from our Website, some functionality of those Website may not be available to you. We may disclose your personal information as required by law. Where you have provided information to us on a confidential basis, we will hold that information in confidence, except as required by law. We cannot guarantee that our website is secure, and we cannot be held responsible for a breach of our website security that is beyond our control. You can request details of your personal information that we hold, and ask us to correct it, at any time

7. Miscellaneous

7.1. Applicable law and jurisdiction. Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside. Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of website or supply of any services. Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).You agree to use our website, products and services in accordance with the applicable laws of the country or countries where your business or organisation is based.

7.3. Survival. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

7.4. Changes to Terms of Use and Assignment. Pathways College On Demand may, from time to time, change these Terms of Use. We will notify you at least 30 days before these new Terms of Use apply to you. We may assign or transfer our agreement with you including our associated rights and obligations at any time and you agree to cooperate with us in connection with such an assignment or transfer.

7.5. Electronic Communications. We will send you information relating to your account (e.g. changes in password, confirmation messages, and notices) in electronic form only, for example via emails to your email address provided during registration.
